Background

The National Council for Children’s Services (NCCS) is a semi Autonomous Government Agency (SAGA) established under Section 30 of the Children Act 2001. The organization is mandated to exercise general supervision and control over the Planning, Financing and Co-ordination of Child Rights and welfare in Kenya.  This financial year NCCS will focus on its research on children of imprisoned mothers.

The adoption of the Convention on the Rights of the child by United Nations General Assembly (UNGAS) on 20th November, 1989  marked the beginning of the world approval of children’s entitlement to rights which are unique to their status.  The convention on the rights of the child and the African Charter on the Rights and Welfare of the Child are domesticated in the Children Act 2001.  The Constitution of Kenya which was promulgated on 27th August, 2010 marked the beginning of a new constitution order for children and therefore promotes protection of children.

STUDY OBJECTIVES/ TASKS

  • To Establish the impact of the mothers imprisonment on the children who accompany them to prison and on the children left behind not accompanying mothers to prison
  • To Establish the age of mothers accompanied by children in prison and the rate of recidivism among them and suggest viable  programmes
  • To Recommend how they can best be reintegrated (children/parent) and the current gaps in their re-integration.
